The goal of the seminar is to advise builders, generally on the process of a construction defect claim, and provide some practice points to protect yourself before, during, and after a claim, from the perspective of building experts, legal counsel and insurance.
General topics being covered:
- Chapter 558 Notice of Claim procedure;
- What to do when served with a Notice and who to contact immediately;
- What qualifies as a construction defect under Chapter 558;
- How construction defect claims typically arise;
- Defects that we typically encounter and how to prevent them;
- Insurance coverage that must be obtained to protect contractors & subcontractors;
- Exclusions in insurance policies that leave contractors & subs exposed;
- Indemnification issues.
The Developers Council is a group of committed developers, builders and associate members who meet monthly to discuss prominent issues and topics relating to the residential construction industry.
